PROCEDURES ON THE ENTRY AND RELEASE OF YACHTS FOR SAIL BUNAKEN 2009 TO AND FROM CUSTOMS AREA

In relation with Presidential Decree No. 2 of 2009 on National Committee for Implementation of Sail Bunaken 2009, it is necessary to issues technical procedures on the entry and release of yachts for the purpose of Sail Bunaken 2009 to and from the customs area as follows:

A. General

Entry and release procedures yachts for the purpose of Sail Bunaken 2009 to and from customs areas are set out in this Circular that is used to serve the yachts that participate in the Sail Bunaken 2009.

B. Port of Entry and Release

1. Sea ports are stipulated as ports of entry and release ports are:

2. In case of entry and releases in other ports as intended in paragraph (1), yacht rally participant must report to the nearest Customs office of Integrated Post of Sail Bunaken 2009 in destination port.

C. TEMPORARY IMPORT OF YACHTS

1. Category of Temporary Import of Yachts.

On the entry of yachts for the purpose of Sail Bunaken 2009 will be granted temporary import permit by get exemption of Import Duty and Tax on the Import.

2. Application for Temporary Import Permit

To obtain a temporary import permit, the Director General of P2SDKP as Chairman of the Organizing Committee of Sail Bunaken 2009 apply for a temporary import permit to the Director General of Customs and Excise with the format as in Appendix I of this Circular, by attaching the data as intended in Appendix II of this Circular.

3. Guarantee

Application for a temporary import permit is treated as a guarantee for temporary import of yachts concerned.

4. Period

Period of temporary import permit of yachts for the purpose of Sail Bunaken 2009 to the Indonesian customs area apply within a period of 150 (one hundred fifty) days from the date of Notification of Imported Goods (PIB).

D. IMPORTATION

1. Notification of Imported Goods (PIB)

Before import yachts, Yacht Rally participants shall submit Notification of Imported Goods (PIB), a copy of a temporary import permit and other customs complementary documents and Inward Manifest to the Head of Customs Office the point of entry.

2. Supporting Documents

In addition to customs complementary documents, participants are required to submit documents on the identity and technical specifications of ships (e.g. Ship's Particular or such documents).

3. Physical examination

Based on yachts data from the supporting documents attached, the Customs officials can perform a physical examination of the yachts.

E. RELEASE

1. Notification of Exported Goods (PEB)

Before yachts are released from customs area, Yacht Rally participants shall submit Notification of Exported Goods (PEB) to the Head of Bitung KPPBC equipped with an Outward Manifest for overseas destinations.

2. The Transit port

In terms of yacht will go through several shelter ports, in the Outward Manifest listed the names of ports that will be visited and yacht rally participant submit Outward Manifest for overseas destination to the Head of Customs Office that oversees the last shelter port before go overseas.

F. SPECIAL SIGN

1. In the framework for facilitation of the implementation of supervision by the relevant agencies, yacht of Sail Bunaken 2009 participants must use the SPECIAL SIGN created by Director General of P2SDKP.

2. SPECIAL SIGN is given at the port of entry on a yacht that meets the requirements specified.

3. SPECIAL SIGN shall be installed during the Sail Bunaken 2009 activities, making it easier to recognize.

G. NON TAX STATE LEVY

Non tax state levy for every customs service in the framework of Sail Bunaken 2009 is charged to the budget of Directorate General of P2SDKP.

H. SANCTIONS

1. Temporary Import permit for yachts based on this Circular only to be used for Sail Bunaken 2009 and should be released from the Indonesia customs area before ending period of temporary import permit;

2. In terms of yacht is not released from the customs area after period of temporary import permit expired and/or used for other purposes than the activities of Sail Bunaken 2009, will be penalized according to the provisions in force.

This is to be implemented with the full sense of responsibility.
